1. Service Description

gpt-image2.design ("we", "us", "the Service") is an AI-powered image generation platform operated at gpt-image2.design. The Service allows registered users to generate images using large-language-model and diffusion-based AI systems via a web interface and API.

2. Eligibility

You must be at least 18 years old to create an account. By registering you represent that you meet this age requirement and that the information you provide is accurate. Accounts are personal and non-transferable.

3. Acceptable Use

Your use of the Service is governed by our Acceptable Use Policy, which is incorporated by reference into these Terms. Violation of the AUP may result in immediate account suspension or termination.

The Service expressly prohibits generating NSFW, sexually explicit, or sexually suggestive content, including through the web app or API.

4. Intellectual Property

You retain full ownership of images you generate using the Service for personal or commercial purposes. We do not claim any rights over your generated images. You grant us a limited, non-exclusive license to store and deliver the images to you as part of operating the Service.

The Service software, branding, and underlying models remain the property of their respective owners. You may not copy, reverse-engineer, or redistribute any part of the platform itself.

5. Credits

The Service operates on a credit system. Credits are consumed when you generate images. Credits are generally non-refundable except as described in our Refund Policy. Credits do not expire while your account is active. Credits have no monetary value and cannot be transferred or sold.

6. Limitation of Liability

The Service is provided "as is" without warranty of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

7. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms, the AUP, or any applicable law. Upon termination, your right to use the Service ceases immediately. Unused credits are forfeited on termination for cause.

8. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of competent jurisdiction in Delaware.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
